WiseHeart Quick-Read User Agreement

1. What You Permit Us to Do

  • Use Your Data to Help You. We collect heart signals, motion, and other info you choose to share (like meals or screen time) so the app can spot stress and suggest ways to calm down.
  • Improve the Product. Our team—and trusted, trained reviewers (both people and AI models)—may look at your data inside our company to fine-tune algorithms, run A/B tests, squash bugs, and create new features.
  • Keep It Private. We never sell or hand your personal data to advertisers or other third parties. We may publish aggregated, anonymous statistics that can't identify you.
  • Store It Securely. Data travels to our encrypted cloud in the U.S. and stays there until you delete your account or ask us to erase it.

2. Your Choices

  • Connect or Disconnect. You can link Apple Health, Google Fit, calendars, etc., or turn them off at any time.
  • Delete. By deleting your account we will permanently delete all your data on our servers - no questions asked.

3. Good-Sense Rules

  • Not Medical Advice. WiseHeart is a wellness tool, not a doctor, psychologist or therapist. For urgent or serious health issues, call 911 or see a professional.
  • Heart-Alert Follow-Up. If we ever flag a possible irregular or unusual heart rhythm, we'll tell you. It's up to you to seek timely medical attention to find out whether it needs further care.
  • Age 18+. If you're under 18, please wait until you're an adult to use WiseHeart.
  • Use Safely. Don't rely on notifications while driving or performing dangerous tasks.

4. Our Promises & Limits

  • We Work Hard to Keep You Safe, but technology isn't perfect. We provide the app "as is" and can't guarantee uninterrupted service or that every stress reading will be right.
  • Limited Liability. To the fullest extent allowed by U.S. law, any claim against us is capped at the amount you paid us in the last 12 months.
  • Updates Happen. Features and terms may evolve. We'll notify you of material changes, and your continued use means you accept the new terms.

5. Privacy Policy

In particular we follow the CCPA privacy policy described here which gives you these rights:

  • The right to know what personal information is being collected about them.
  • The right to know whether their personal information is sold or disclosed and to whom.
  • The right to say no to the sale of personal information.
  • The right to access their personal information.
  • The right to equal service and price, even if they exercise their privacy rights.
  • The right to delete their personal information from all the business' servers.

6. Legal Fine Print (Still Plain English)

  • Governing Law: These terms follow the laws of the State of Delaware, USA.
  • Dispute Resolution: If we have a serious disagreement, we'll try to resolve it informally first. If that fails, we both agree to binding arbitration (no jury trial), handled by the American Arbitration Association in your county or online.
  • Severability: If one part of this agreement is invalid, the rest still stands.
  • Entire Agreement: This is the whole deal between us regarding WiseHeart; it replaces any prior agreements or conversations.

User-Facing Disclaimers

Not Medical Advice: "WiseHeart is an AI-powered self-help coach. It is not a licensed health-care provider and does not give medical or mental-health advice, diagnosis, or treatment."

No Emergency Use: "If you feel unsafe or think you may harm yourself or others, call 911 or 988 (Suicide & Crisis Lifeline) immediately."

No Therapeutic Relationship: "Use of WiseHeart does not create a patient-therapist relationship or any duty of care."

AI & Fallibility: "Responses are generated by artificial intelligence and may occasionally be inaccurate or inappropriate."

Informed-Consent Checkbox: "You are over 18 and understand the above limitations. You consent to the collection and processing of conversation data for service delivery and improvement."

Data Privacy & HIPAA: "Our messages are encrypted. We store them securely and do not share with advertisers without your explicit consent. For details see our Privacy Policy."

Jurisdictional Notice: "Service offered from the State of Delaware. Some features may not be available where prohibited by law."

FDA Wellness Scope (if applicable): "WiseHeart is intended for general wellness purposes only and has not been cleared or approved by the U.S. FDA."

Scientific Claims Disclaimer: "Any references to clinical benefits are based on published research into mindfulness and cognitive-behavioral techniques; individual results will vary."

Update Clause: "We may update these terms and will notify you before changes take effect."
